Are you lead certified? MN Cities want to know!

New Minnesota Requirements – Effective February 1, 2011

Beginning on February 1, 2011, Minnesota Cities that have adopted the State Building Code will be required to verify that certain contractors have proof of their lead certification before issuing permits to perform residential work.

According to Chapter 321, the Minnesota Statutes have been amended as follows:

Lead certification. When issuing permits in compliance with the State Building Code to a residential building contractor, residential remodeler, manufactured home installer, or residential roofer licensed under section 326B.805, municipalities must verify lead certification qualifications of the licensee required under subdivision 14 for renovations performed on residential property constructed prior to 1978. Municipalities may charge a surcharge for verification of this certification under section 326B.815, subdivision 2.

This rules applies to work that will be performed in residential properties constructed prior to 1978. Specifically, the verification will be required prior to issuing permits to the following Minnesota Department of Labor and Industry (DOLI) licensed contractors:

  • Residential building contractors
  • Residential remodelers
  • Manufactured home installers
  • Licensed residential roofers

Municipalities will be required to confirm that contractors have:

1) successfully completed the required training and

2) have received their EPA lead renovator firm certification.

The city may charge a $5 surcharge for verifying lead certification.

Some cities are already accepting proof of lead certification and many have already revised their permit application forms. Check with your local municipality for more information.
